TO AVOID DETECTION, SILVA ACCESSED THE FIRM’S ACCOUNTING SYSTEM AND REPLACED THE VENDOR CHECK NUMBER WITH THE CHECK NUMBER OF THE CHECK MADE PAYABLE TO SILVA, CONVERTING OVER $456,000 THROUGH THIS METHOD. SILVA ALSO ISSUED APPROXIMATELY 109 CHECKS PAYABLE TO HIMSELF TOTALING OVER $333,000. IN NUMEROUS INSTANCES, SILVA ACCESSED THE FIRM’S ACCOUNTING SYSTEM AND ENTERED THE NAME OF ANOTHER FIRM EMPLOYEE AS THE PAYEE FOR THE CHECK. IN ADDITION, SILVA ISSUED AT LEAST 5 CHECKS PAYABLE TO AN ALIAS OF SILVA TOTALING OVER $52,000. AND SILVA ISSUED APPROXIMATELY 90 CHECKS PAYABLE TO FIRM EMPLOYEES AND VENDORS, WHICH WERE ENDORSED AND DEPOSITED IN ACCOUNTS OWNED BY THIRD PARTIES ASSOCIATED WITH SILVA. SILVA CONVERTED AT LEAST $587,000 THROUGH THIS METHOD. IN ADDITION, SILVA FORGED THE SIGNATURES OF THE FIRM’S PRINCIPALS ON THE CHECKS. SILVA CONVERTED FUNDS BELONGING TO THE FIRM FOR HIS OWN BENEFIT AND FORGED SIGNATURES ON CHECKS. According to a study prepared for the FINRA Investor Education Foundation, 80 percent of American investors report that they have been solicited to participate in a fraud scheme, while 11 percent of American investors report that they personally lost money as a result of fraud.

• Breach of Fiduciary Duty: Under the Investment Advisers Act of 1940, certain investment professionals, known as registered investment advisors (RIAs), owe fiduciary obligations to their customers. If you lost money because of your broker’s breach of fiduciary duty, you may be entitled to compensation for the full value of your damages.
• Unsuitable Investments: Many financial advisors are not fiduciaries. Instead, they are held to the suitability standard. These stockbrokers and financial advisors can only sell and recommend financial products that are appropriate for a customer’s unique investment profile. If you lost money in unsuitable investments, you should consider reporting them.
• Material Misrepresentations or Omissions: Brokers have a duty to make fair and honest representations to their clients. If they fail to do so, and an investor loses money due to a misrepresentation or a material omission, the broker may be liable for the investor’s losses.
