A COMPANYWIDE RETIREMENT GREETING WAS CIRCULATED ON OCT. 28, 2021, BUT COMPLIANCE REQUIRED ANOTHER LETTER FOR RESIGNATION INSTEAD ON NOV 15, 2021, AND DELAYED PROCESS OF MY U5 UNTIL LATE DECEMBER 2021. MY BUSINESS LINKEDIN WAS RUN BY HEARSAY UNTIL I RETIRED, AND THERE WAS NEVER AN ISSUE DISCUSSED ABOUT AN ALLEGED DATA ENTRY ERROR ON A LIFE INSURANCE E-APP, WHICH HAS NOTHING TO DO WITH MY SECURITIES LICENSES OR ANY INVESTMENT RELATED BUSINESS. FURTHER ALLEGATION OF UNDISCLOSED TWO BUSINESS NAMES PERTAINED TO AN OLD 2001 NAME REGISTRATION THAT WAS NAME CHANGED (CDI CORP SERVICES TO ITC TRADE) UNDER THE SAME EIN THAT CEASED OPERATING EVEN BEFORE MY EMPLOYMENT AT NYL IN 2008, AND WAS PROPERLY DISCLOSED ON RECORD, AND WAS ALREADY CLARIFIED BY SUBMISSION OF ITS ARTICLES OF DISSOLUTION EVEN BEFORE MY RETIREMENT. • Allegations: Customers allege the surrender charges associated with two variable annuities purchased in or around May of 2013 were not fully explained to them. The customers further allege that the RR failed to follow their instructions with regard to how the funds were allocated within the annuity. They request cancellation of the policies with a waiver of surrender charges.

• Broker Comment: The original complaint alleged a privacy allegation against the Firm for which the customer requested a waiver of contractual surrender charges. When the relief requested was denied, the Firm subsequently received the above allegation. After reviewing the matter, the Firm determined the customer was informed of the surrender charges at the time of sale, and the claim was not substantiated against the agent. Thus, the company found no basis to offer extra-contractual relief.

According to a study prepared for the FINRA Investor Education Foundation, 80 percent of American investors report that they have been solicited to participate in a fraud scheme, while 11 percent of American investors report that they personally lost money as a result of fraud.

FINRA notes that the rate of investment fraud is most likely much higher than it is reported. This is because many victims of financial advisor scams are too ashamed to come forward. Further, the study also found that a significant number of investors do not know how to spot common red flags of investment fraud. • Unsuitable Investments: Many financial advisors are not fiduciaries. Instead, they are held to the suitability standard.
