CLIENT CLAIMS, AFTER RECEIVING THE 1099R FROM HARTFORD, THEY CONTACTED THE IR TO CONFIRM THE INFORMATION REGARDING THE TAXES. CLIENT STATES, AT THAT TIME, THEY WERE ADVISED THEY WOULD OWE TAXES ON THE FULL AMOUNT LIQUIDATED. CLIENT CLAIMS THEY CANNOT AFFORD $9,000.00 IN TAXES AND, AS A RESULT OF THE ADDITIONAL INCOME, THEIR SOCIAL SECURITY BECAME TAXABLE. CLIENT BELIEVES THEY WERE MISINFORMED AND SHOULD HAVE SOME RECOURSE WITH REGARD TO THIS SITUATION. FILING REQUIRED.

• Broker Comment: OUR RECORDS REFLECT, AT THE TIME OF THE MAY 2005 DISTRIBUTION, THE CLIENT COMPLETED AND SIGNED AN ANNUITY FULL LIQUIDATION LETTER IN WHICH SHE ELECTED TO HAVE NO TAXES WITHHELD FROM THE WITHDRAWAL. THE IR HAS INDICATED WITHDRAWALS HAVE BEEN PREVIOUSLY MADE FROM THE ACCOUNT FOR WHICH THE CLIENT WOULD HAVE RECEIVED 1099R’S. IN ADDITION, HE HAS STATED THE CLIENT WAS ADVISED OF THE POTENTIAL FOR TAX CONSEQUENCES AND IT WAS ALSO SUGGESTED THAT THE CLIENT CONSULT WITH A QUALIFIED TAX PROFESSIONAL WITH SPECIFIC QUESTIONS RELATED TO THE WITHDRAWAL. THE IR BELIEVES THE CLIENT CONTACTED HIM WHEN PREPARING HER TAXES AND, IT WAS AT THAT TIME, HE STATED HE WOULD REVIEW HIS RECORDS AND CONTACT HARTFORD TO DETERMINE IF THE FULL AMOUNT OF THE WITHDRAWAL WAS TAXABLE. BASED ON OUR REVIEW, IT APPEARS ADEQUATE DISCLOSURE WAS MADE RELATED TO THE POTENTIAL TAX CONSEQUENCES OF THE DISTRIBUTION; THEREFORE, WE ARE RESPECTFULLY DENYING THE CLIENT’S REQUEST FOR A REIMBURSEMENT OF THE TAXES INCURRED AS A RESULT OF THE LIQUIDATION OF THE ANNUITY. CLAIM DENIED.

According to a study prepared for the FINRA Investor Education Foundation, 80 percent of American investors report that they have been solicited to participate in a fraud scheme, while 11 percent of American investors report that they personally lost money as a result of fraud.

• Unsuitable Investments: Many financial advisors are not fiduciaries. Instead, they are held to the suitability standard. These stockbrokers and financial advisors can only sell and recommend financial products that are appropriate for a customer’s unique investment profile. If you lost money in unsuitable investments, you should consider reporting them.
• Material Misrepresentations or Omissions: Brokers have a duty to make fair and honest representations to their clients. If they fail to do so, and an investor loses money due to a misrepresentation or a material omission, the broker may be liable for the investor’s losses.
• Lack of Diversification: Brokers must also act with the appropriate level of professional skill. Pushing a customer into over-concentrated investments is highly risky. Brokers can be held liable for losses sustained because of an investor’s inappropriate lack of diversification.
• Excessive Trading (Churning): Stockbrokers and financial advisors must have a well-grounded, reasonable basis to execute all trades.
