ALL OF THE DEBT WAS IN MY PERSONAL NAME EVEN THOUGH LATER I HAD A LLC CREATED FOR THE BUSINESS CALLED POWER TEAM PROPERTIES. I WAS AND CURRENTLY STILL AM AN ACTIVE MEMBER OF THE ARMY RESERVE AND IN MID 2008 I WAS ACTIVATED AND DEPLOYED BACK TO IRAQ. A COUPLE MONTHS AFTER I DEPLOYED MY PROPERTY MANAGER AND MAINTENANCE MAN QUIT UNEXPECTEDLY BECAUSE HE GOT DIVORCED. MY WIFE WHO WAS WORKING FULL TIME HERSELF TRIED TO KEEP UP WITH THE REAL ESTATE BUSINESS BUT WITH ME BEING IN IRAQ IT WAS NOT EASY. WITHOUT THE MAINTENANCE MAN SHE STARTING HAVING TO USE CREDIT CARDS TO PAY MORE EXPENSIVE MAINTENANCE PEOPLE TO MAKE NEEDED REPAIRS ON MULTIPLE PROPERTIES. ALSO WITHOUT A MANAGER THE VACANCY RATE WENT UP ON THE PROPERTIES ADDING TO THE FINANCIAL PROBLEMS. WITH THE REAL ESTATE MELT DOWN IN LATE 2008 AND 2009 BY THE TIME I CAME BACK FROM IRAQ (RELEASED FROM ACTIVE DUTY IN JANUARY 2010)I COULD NOT GET THE BANK TO REFINANCE MY PROPERTIES TO GET BACK ON TRACK. I EXPLAINED TO MY CREDITORS WHAT HAD HAPPEN AND WORKED TO GET THE REAL ESTATE BUSINESS BACK ON TRACK. I WAS ABLE TO MAKE GOOD ON ALMOST ALL OF MY DEBTS BY WORKING WITH MY CREDITORS AND GETTING THE BUSINESS BACK ON TRACK. UNFORTUNATELY, I WAS NOT ABLE TO ELIMINATE ALL OF THE DEBT AND WAS ADVISED BY MY ATTORNEY TO FILE BANKRUPTCY AS MY LAST OPTION. According to a study prepared for the FINRA Investor Education Foundation, 80 percent of American investors report that they have been solicited to participate in a fraud scheme, while 11 percent of American investors report that they personally lost money as a result of fraud.

If you lost money because of your broker’s breach of fiduciary duty, you may be entitled to compensation for the full value of your damages.
• Unsuitable Investments: Many financial advisors are not fiduciaries. Instead, they are held to the suitability standard. These stockbrokers and financial advisors can only sell and recommend financial products that are appropriate for a customer’s unique investment profile. If you lost money in unsuitable investments, you should consider reporting them.
• Material Misrepresentations or Omissions: Brokers have a duty to make fair and honest representations to their clients. If they fail to do so, and an investor loses money due to a misrepresentation or a material omission, the broker may be liable for the investor’s losses.
• Lack of Diversification: Brokers must also act with the appropriate level of professional skill. Pushing a customer into over-concentrated investments is highly risky. Brokers can be held liable for losses sustained because of an investor’s inappropriate lack of diversification.
• Excessive Trading (Churning): Stockbrokers and financial advisors must have a well-grounded, reasonable basis to execute all trades. Unfortunately, there are cases in which brokers will frequently trade on a customer’s account, simply to increase their own fees. This unlawful practice is known as churning.
