THE CLIENT FURTHER ALLEGED THAT THIS SECURITY WAS NOT IN LINE WITH HIS INVESTMENT GOALS.

• Broker Comment: THE INDIVIDUAL WHO SENT THE E-MAIL AT ISSUE STATED TO MY COLLEAGUE AND A UBS MANAGER THAT WE DID NOT DO ANYTHING WRONG AND THAT HE DOES NOT BLAME ME FOR THE FAILURE OF LEHMAN BROTHERS. THE INVESTMENT IN QUESTION WAS PURCHASED LONG BEFORE LEHMAN BROTHERS BANKRUPTCY, WHICH WAS NOT FORESEEABLE AT THE TIME OF THE INVESTMENT. I DO NOT BELIEVE THAT THE E-MAIL WAS MEANT TO BE A COMPLAINT ABOUT ME; HOWEVER, AS THE ADVISOR OF RECORD, I AM REQUIRED TO MAKE THIS SUBMISSION.

• Unsuitable Investments: Many financial advisors are not fiduciaries. Instead, they are held to the suitability standard. These stockbrokers and financial advisors can only sell and recommend financial products that are appropriate for a customer’s unique investment profile. If you lost money in unsuitable investments, you should consider reporting them.
